40. Where more than one qualifications list is currently valid for the same position, geographical area or, as the case may be, the same department or body, either one of the lists may be used.
In the case of promotions, a qualifications list used to fill positions within a department or a body shall have priority over another qualifications list for filling positions in all departments and bodies.
